1. Who you are dealing with

DM Tags provides photo and headshot booths at events, doing business with Fate Studios Creative, LLC in San Diego, California. In these terms, “we” and “us” mean DM Tags, and “you” means whoever is reading this — a guest at an event, or a host booking a booth.

2. Accepting these terms

By using this website, by signing up at a DM Tags booth, or by receiving photos from us, you accept these terms. If you do not accept them, do not sign up at the booth — nothing is collected from you if you do not.

3. If you are a guest at an event

You sign up by scanning the QR code at the photo station on your own phone and filling in the event’s sign-up form. You must enter your own contact details, and you must be entitled to enter the phone number or email address you give us.

We use the selfie you take to find you in that event’s photographs and send them to you. What we collect, how long we keep it, and when we destroy it is set out in the privacy policy.

You must be old enough to agree to these terms on your own behalf. A child should only sign up with a parent or guardian present.

4. Text messages

Text messages are optional and you opt in by ticking a separate box, unchecked by default, on the sign-up form. If you do not tick it you still join the queue and still receive your photos by email.

Message frequency varies. Message and data rates may apply. The messaging program is described in full on the SMS messaging program page.

5. If you are a host booking a booth

The quote form on this site is a request, not a booking. A booking exists once we have confirmed it with you in writing, and the price, dates, hours, deposit and cancellation arrangements for your event are whatever that written confirmation says.

You are responsible for the venue giving us the space, power and access the booth needs, and for telling your guests that a photo booth using facial recognition will be at your event.

The event photographs are yours. We keep them, and keep the gallery open, until you ask us to remove them. Taking down a particular photograph at a guest’s request is your decision.

6. Your photos

The photos we send you are for your own personal use — keep them, print them, post them. Do not resell them, and do not use a photo of somebody else in a way they would not want.

We may not be able to find you in every photograph. Facial recognition is not perfect, and lighting, angles and crowds all affect it. We make no promise that every photo you appear in will reach you.

7. Using this website

Do not attempt to break, overload, or gain unauthorised access to this site or the systems behind it, and do not use it to send anything unlawful. The text, images, branding and design on this site belong to us or to the people we licensed them from.

8. Availability

We do our best to keep the booth, the gallery and the delivery running, but we cannot promise they will be available without interruption. Equipment fails, venues lose power, and networks drop.

9. Limits

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, and our liability to a host is limited to what you paid us for the event in question.

Nothing in these terms limits anything that cannot be limited by law.

10. Changes

If we change these terms we will change the date at the top of this page. The version published here is the one that applies.
